A 59-year- old Herbert Swilley was arrested and charged with first-degree murder after his husband, Timothy Smith, 55, had been drugged, beaten, strangled, and found by police on March 23.
Sheriff's deputies said Smith had previously been abused by Swilley and had tried to leave the relationship before he was killed.
According to Sheriff's deputies, Swilley murdered his husband because he was the beneficiary of Smith’s life insurance policy. The benefit amount was supposed to be 333 thousand dollars.
