The victim filed a lawsuit, where he claimed the payment of 100 thousand rubles (498 thousand tenge at the National Bank rate), moral harm in the amount of 20 thousand rubles (99.6 thousand tenge at the National Bank rate) and a fine of 6 thousand rubles (29.8 thousand tenge at the National Bank exchange rate) from the insurance company.
The claim was satisfied by the district court’s decision, and the total amount of 180 thousand rubles (896.8 thousand tenge at the National Bank exchange rate) was recovered from the defendant. While disagreeing with the court's decision, the insurance company’s representative asked to cancel the decision.
The Supreme Court of Buryatia upheld the district court’s decision without change. The verdict emphasized that the plaintiff suffered serious injuries in a traffic accident while being a passenger of a vehicle and not a driver.
The cause of the plaintiff's first group disability was injuries received as a result of a road traffic accident that occurred due to the driver's violation of the Traffic Rules, and not as a result of the plaintiff's consumption of alcohol, the court noted.
